98,000 Deaths Occur Each Year Due to Medical Negligence: The National Academy of Sciences' report shows that more people die from medical error than from car accidents, breast cancer, or AIDS. Most Injured Patients Never File a Claim: A study by Harvard Medical School, found that eight times as many patients are victims of medical malpractice as ever file a claim, and sixteen times as many are injured as ever receive compensation. ("Patients, Doctors and Lawyers: medical injury, malpractice litigation, and patient compensation in New York." 1990. Harvard Medical Practice Study. )

Just 5% of doctors were involved in 54% of all medical malpractice payments between 1990 and 2002, according to the National Practitioner Data Bank of the Dept of Health & Human Services.

MEDICAL MALPRACTICE CASES SHERRY HAS HANDLED

Shope v. Murfreesburo Nursing Center - Jury verdict of $250,000 in actual damages and $1,000,000 in punitive damages.  This was an action against a nursing home in rural Arkansas, for injuries to a 93 year-old resident, Jeames Shope. Mr. Shope was abused by a nurse?s aid who did not have proper training. The abuse was not properly reported to the authorities and there was evidence of numerous regulatory violations. Medical specials totaled approximately $5,000.

Death of young woman due to injuries sustained during delivery: A 36 year-old woman was admitted to the hospital for the birth of her third child.  During delivery, her uterus ruptured, and she ultimately went into shock due to blood loss.  Because the shock went untreated for so long, she developed multi-system organ failure and died.  The baby survived.  On behalf of himself and all three children, her husband filed suit in Pulaski County, Arkansas.  The case settled for a confidential amount prior to trial.  Go to Case illustrations to view trial exhibits that were produced for this case.

Brain damaged infant due to birth trauma: A 31 week, premature fetus was delivered with the use of forceps.  The forceps were improperly applied by the doctor and caused the infant's skull to be fractured.  As a result, the infant developed subdural and subgaleal hemorrhaging, which led to severe brain damage and physical disabilities.  The case settled for a confidential amount prior to trial.  Go to Exhibits to view one of the trial exhibits that was produced for this case.

Dental malpractice: Multiple cases against orthodontist for: failure to use proper materials; failure to properly monitor progress; failure to timely remove braces; and failure to make appropriate referrals to other specialists.  The damages varied, but all involved some degree of bone loss with anticipated future loss of permanent teeth.  One case settled on the first day of trial, and three others settled prior to trial.  All were confidential settlements.
